REGISTRATION OF DAIRIES.
A TEST CASE. A case which will affect hotels and lodg-ing-houses where private dairies are kept ■was decided in the Christchurch Magistrate's Court this morning, when Mr W. R. Hasslden, S.M., gave reserved judgment, in the case Alexander M'Pherson (Inspector of Dairies) v. John Cooper, licensee of- the Phoenix Hotel. The defendant is charged, his Worship said, with selling milk other than that obtained from a- registered dairy. Under regulations made in pursuance of the Dairy Industry Act, 1898, "no person shall sell any milk other than that obtained from a registered dairy." The facts in this caseare admitted. The defendant is an hotelkeeper at Papanui, and he keeps a milch cow, but has not registered under the Act. He uses the milk obtained from his €oHv in his business as axr hqte3keeper. His family, guests- and customers partake thereof. The question- i» simply, Does be sell any of this milk? Beino more gives away the milk which . his lodgers consume than he gives away the" meat, groceries and bread with which he supplies the- table. In my opinion he sells all these things, just as much as he sells his liquors* in the bar. As is a- test case, and the costs will be somewhat heavy, the- nominal fine of Is is imposed, \vith "Court costs, 7s, and coun^ sel's fee, £1 Is. ' •
