- I—♦1 — ♦ . ...V • [Per. Pbess Association.] WELLINGTON, May 2. In Chambers, this morning, the Chief Justice gave . judgment ij. two preliminary motions in two libel actions. The firet. was an action brought by Swainson and Sevan, of jLinukau, against John Hadfield,, 'of Tehoru, claiming £1000 damages for libel, alleged to be contained in a letter published , in the " Otaki Mail," %he second aotion was brought by A. E. Engleton against E. W. Knowles, of the "Daily Telegraph," Napier, for a libel alleged to he contained in two letters published in the "Telegraph," and £1000 damages was claimed on account of. each letter. The questions involved in both cases were as to the form of the defence, whether the letters were justified as allegations of fact, or as fair comment on a matter of public interest. His Honor thought the defence should set out the facts on which they relied. He expressed the opinion that the plaintiff should not be allowed to plead an innuendo, and failing that, fall back on plain writing without the innuendo.
