COURT OF APPEAL.
[Per Press Association.] 1 WELLINGTON, Oct. 29. Judgment was delivered b^ the Court of Appeal this morning in the cases agaiinst the Assets Company, argued; at the last sitting of the Court in reference to the titles of blocks of land' in the Gisborne district, known as Waingaromi-a No. 3 and Rangatira. Judgment was given for the plaintiffs in accordance with, the opinion of the majority of • tho Court, withi costs £300, and disbursements. The defendant company obtained leave tq appeal to the Privy Council in the fhist case, arfd. applied for leave in the second) case/ Mr Justice Williams held that nothing in the conduct of the company could be considered as fraudulent or improper. Mr Justice Edwards considered that the issue of a certificaite' of title had' been obtained by fraud within the meaning of the Land Transfer Act, but hie did not impute to those who had' acted for the company any motive other than a desire to do what they honestly considered to be their duty to the company.
