Drvskkxxess. — One first offender, who pleaded guilty, because he could remember nothing about the matter, iras fijsed 5s and costs, and two ether first offenders, who did not appear, were fined each 10s and coats, -with tV.e usual alternatives. — Martin Cashion. against whom n prohibition order -was in force, was fined £1, in default seven days' imprisonment. (Before Mr H. W. Bishop, S.M.) Default Casks. — In the following cases judgment was given for the plaintiffs fov default : —Victor Harris v. N. Vale, £2 10s 9d ; Booth, Maudonald and Co. r. William Russell. £18 Os 3d. A Judgment. — Mr Bishop gave judgment in the case Robert Shanks (Mr Widdowfon) v. Edward Vincent (Mr Harper), claim £18 133 for damage inflicted by a runaway horse owned by defendant. The* defendant and his brother had been thrown frcin the trap, and the horse, left to. its own devices, had collided with a horse and vehicle belonging to plaintiff. Defendant had alleged that the runaAvay was due to a defective culvert, and that therefore the local body responsible was liable. The plaintiff had'alleged negligence on the part of defendant. Mr Bishop said that negligence was clearly proved, and that he was quite unable to "believe that the defective culvert ha<l anything to do with the accident. Judgment would be for the plaintiff for the amount claimed and costs. Claim for Damages. — Thomas Ballan (Mr Dougall), claimed £12 2s damages from Charles Wood (Mr Donnelly), for failure to sell a section according Wood gave an agent named Spra.tt authority to sell the land, and Spratt arranged to sell it to Ballaa* for £130. Meanwhile, without giving Spratt notice, plaintiff sold the land elsewhere for £140. After hearing evidence. Mr Bishop gave judgment for the plaintiff for the amount claimed and costs.
