Thursday, Sept. 12. (Before Mr J. Connal, J.P., Mr T. Gapes, J.P., ahd Mr E. Skog, J.P.) Theft. —Edward Campbell wis charged with having stolen a swag, valued at £3, th© property of John O'Neii, on Sept. 10. O'Neii had* left his swag at the railway station, and placed the check dn charge of the barman at the Terminus Hotel. Accused was present at the time, and had drinks with O'Neii. Later he went to the barman, and asked for the check, which was handed over without question. He then took oufc the swag. Accused admitted the facts, but denied any intention of appropriating the swag. He stated he had arranged to go into the country with O'Neii, and had taken the swag out with his own quite openly. He then proceeded to look for O'Neii, biic failed to find him, and lost both swags. He thought he could find them, however. After consideration, -the Bench inflicted a sentence of one week's imprisonment.. Trespass. —ELiza Begarie, who was charged with trespass, was remanded for seven days, as she was under medical treat ment. (Before Mr H. W. Bishop, S.M.) Default Cases. —ln the following cases, judgment was given for the plaintiff, by -default:—James Heslop v. F. G. Quinn and W. H. C. Lanauze, claim £5 os 6d ; Fletcher, Humphreys and Co. v. H. 1). Davenport,"£3 Bs. A Judgment Summons. —Sidney Pigram (Mr Cassidy) claimed £9 las 6d from R. J. Knight (Mr Joynt) on a judgment summons. Tiie deb. or appeared and pleaded inaw.uty to pay. Aiter hearing some evidence Mr Bishop adjourned the ctuse until Monday. Three other similar cases against Knight were also adjourned until Monday. An Unfortunate Deutoii. —W. E. H. Butcher (Mr Bales) claimed joo irom John Power and Minnie Jane i'ower, the amount being due on the purchase of a house and section. The deienduirt <;amitted having owed the money, but stated that he had paid the sum to Mr Allan j-opki-ns, whom, lie had understood, was acting as _ut_her'_ agents. Butcher, however, denied having authorised anyone to receive the money on his behalf, and Hopkins had retail-tied the sum in payment of it debt due from Power. Mr Bisnop said tbat if this was correct, Hopkins ceria-.nly had no right to k^rep the money, but judgment must be for the plaintiff, with costs. A Nonsuit. —A. S. Duncan (Mr Johnston) sued J. Connelly (Mr Slutet) for £l. 18s 2d, the balance said to be due u_ the purchase of a ltaper and binder. The defendant stated tnat the mtm-ey was owed by his son, and after hearing the evidence Mr Bishop iionsuit-.d the plaintiff, with costs. LYTTELTON. TiuutswAV, SKi-r. 12. (Before Capt aai Marciel, J.P.) A iSku'i'ix*; Cask.--K«rl Kruger and H. Schwcrtfeger were charged with having absented themselves without leave from the s.s. Gadsby, at Wellington, t>n August 23. Mr Kippenberger ap,.cured for the accu-ed. Captain Eobinson, master oi the steamer, deposed that the men, who were firemen, had left the vessel at Wtllington without permission. He had written them off the articles as deserters, and had taken out a warrant for their arrest. They had bee.i arrested at Wellington after the steamer had left there, and had been sent to Lyttelton, but had arrived attu- the vessel had left for the, smith. Slie had now returned, and he wished to have them sent back. Mr Kippenberger submitted that this could not be done. The men had been punishtd by having been struck oil the articles and forfeited the wages due to them, and had, moreover, b:cn thirteen days in prison. In reply to the Bench, the captain said that the "men had forfeited their wages. Captain Marciel said that he took the same view as Mr Kippenberger. The men had suif ered the penalty provided by law, and "all that he could do was to discharge them, which he did.
