The "Post" says that an interesting point was raised in a civil action brought before, Mv H. Eyre Kenny, S:M., at Wellington, on Friday, when A. E: Gibbs sued W. F. Grant, of Dannevirke, auctioneer, for £35 '. 17s, money lent, said the plaintiff, purely . for the purpose of enabling the defendant to • pay some gambling debts. Mr Tringham appeared for plaintiff. It was amply proved that the money had been lent in Christchurch, and the excuse for its non-payment was that {is Court proceedings had been instituted, jthe defendant would stand on his legal rights. Mr Young, who represented the defendant, said the defence was quite a legal . one. As the money was lent while the game of poker was in progress', in which both parties were playing, it was not reccver- • able. Further, it was a game of chance, and ; though it might in itself be legal, betting on it was. illegal. Mr Kenny, S.M. : Then, the question is whether money lent to a man under these circumstances, to pay his gambling debts, is recoverable by law. I will deliver judgment later.
