CIVIL SITTINGS.
Monday, Feb. 22. (Before his Honor Mr Justice Denniston.) ANDERSON V. ANDERSON. This was a case in which Kate Anderson, of Christchurch* laundress, sued George Anderson, <jf Christchurch, bootmaker, for possession of a house and section in Linwoorl, and' the sum of .£lO for niesne profits. The defendant admitted the occupation of the property, but denied that ho was unlawfully in possession, but was living there by right and an agreement. He contended that in 1890 the plaintiff was in possession of the land, and being desirous of erecting a house she agreed with him and with her mother that she should give to the plaintiff the sum of £60 towards erecting the tenement, and that she should borrow on mortgage the sum of <£200 for that purpose. The plaintiff further agreed with the defendant that, if he would assist in maintaining her mother and herself until such time as the plaintiff had paid off the said mortgage debt of .£2OO, she would permit the defendant and her mother to reside in the house free of rent until the mother's decease. The defendant claimed that he had carried out his part of the covenant, and had paid large sums for the support and maintenance of his sister (the plaintiff) and her mother. The plaintiff had baen iv possession of and had resided in the said house since its erection, until a short time since, when she voluntarily withdrew herself from the premises. Mr .Toynt appeared for the plaintiff, and Mr Russell for the defendant. After hearing evidence and argument, his Honor gave judgment for the plaintiff, with possession of the premises. Costs to be on the lowest scale.
