SUPREME COURT.
IN CHAMBERS. Friday, Nov. 6. (Before his Honor Mr Justice Denniston.) His Honor held a sitting in Chambers at 11 a.m. bmith v. smith and another (divorce). . Mr Bruges applied for an order for substituted service in regard to the co-respon-dent. His Honor said that there had been » delay of two years in this matter, for which the co-respondent was not responsible. The man was now out of the place, and he (His Honor.) did not see how he could, under the circumstances, practically be made responsible for costs without service. After discussion Mr Bruges asked leave to postpone the application. His Honor said that he would grant that. Mr Kirk, on behalf of the respondent, appeared in a support of a summons for leave to file answer herein. His Honor said that it appeared to him that the application had better stand over till the question of service on the co-res-pondent had been disposed of. After further discussion his Honor said Mr Kirk's application could stand over sine die, Mr Bruges to give notice to Mr Kirk of any subsequent proceedings. RE B. T. RHODES, DECEASED. Mr Eoss obtained an order for commission herein. LAND TRANSFER ACT AND RE CAVEAT 1908. Mr Beswick appeared in support of a summons for the removal of caveat 1908. Mr Hall, for the- holders of the caveat, consented, and his Honor made the order as prayed. A similar order was made in respect of caveat 1909. PATTERSON^V. MURRAY. Mr Cowlishaw, for the plaintiff, applied for an order for discovery herein. Mr Kirk, on the other side, consented, and his Honor made the order as prayed. . RE EDWARD WILDS, DECEASED. ::■'".. Mr Heiniore obtained an order for letters' of administration. herein. • • RE JOHN BROWN, DECEASED. On the application of Mr Beswick, his Honor granted probate of the will of John Brown, deceased. ELL V. HARPER. Mr Caygill appeared in support of a summons by the plaintiff for the examination of the Official Assignee. Mr Stringer appeared on behalf of the Official Assignee. As this was strictly a Chamber matter, it was heard before hie Honor in private.
