RANGIORA.
Tuesday, Jan. 14. ' (Before Mr H. W. Bishop, S.M., Mr A. Todd, J.P., and Mr E. R. Good, J.P.), Application for Re - hearing oe a Cabe. — The application made by Mr Deacon last Court day for a re-hearing of the case, A. S. Clarkson v; A. Worsfold, and held over, was dismissed. Mr Cathro appeared for defendant* . Public Domains Act.— A. Worsfold was charged by Captain Parsons, chairman of the Rangiora Domain Board, with haying, on Nov. 26, wilfully broken down part of the fence of the recreation ground. Mr Bishop for informant; Mr Cathro for defendant. Defendant's, land adjoins the recreation ground, and evidence was given by J. Hands, caretaker, and A. S. Clarkaon, secretary to the Board, that he made a gap through the fence to cross the ground ; and that when remonstrated with he asserted his right to pass through the fence in spite of caretaker or Board. The case for the prosecution was closed without Captain Parsons' authority to lay the information being shown, or the date of the offence being proved. The Stipendiary Magistrate said it was not for him to build up the case for the prosecution, and the information would be dismissed.
