i . BE G. P. MOTU. Mr Papprill moved in re the bank- [ ruptcy of G. P. Miitu, Kaiapoi, for leave ito continue action. He cited authorities for Baying that there wai a right to continue the action against either the trustee or against the debtor. Mr Joynt appeared for the trustee, and said that he had no interest in the case, and Bhould not be joined in the action. His Honor said that the trustee might I be joined if Mr Papprill pressed, but he did not think that anything more than formal notice served on the trustee was required. It might, however, even be to the interest of the trustee to be made a patty with the Official Assignee, and he would not be liable to any expense.
