THE SYDENHAM LICENCE.
The Appeal Allowed, His Honor Mr Just'oe Denniston sat this morning, and delivered judgment m the appeal case, Had field v. Armstrong :— The question to bo disposed of in the appeal had been, his Honor eaid, was tha magistrate entitled to take evidence upou, and decide the validity of, the cert i6c*te ? The appellant produced a license iu due form from the proper authority, and also a certificate. There bad been, nothing on the face of the proceedings t:> suggest any incapacity. Was a magistrate entitled to go behind this apparently regular procedure of a Licensing Court, and receive evidence as to the existence or non-existence of the conditions which would authorise such, procedure ? His Honor then proceeded to deal with the questione of fact and law, and l concluded by eayir.g tbat the respondent's counsel had not attempted to justify tbe convict r on on principle, but had relied, as he bid said, entirely on the authorities he cited, not one of which seemed to his Honor to even remotely support the contention raised.
