THIS DAT. (Before his Honor Mr Justice Denniston.) CLARIDGE V. THE UNION STEAMSHIP COMPANY. Mr Wilding, with him Mr Bruges, for the plaintiff ; Mr Harper, with him Mr H. N. Nalder, for the defendant. In this action, which had been heard before his Honor and a special jury of twelve, the plaintiff, who had been working aB a dock labourer, sought to recover damages on account of injuries caused by a basket of coal falling on him while he was discharging cargo on the s.s. Orowaiti at Lyttelton. The fall of the basket was, it was alleged, caused by the negligence of the Company's servants, members of the crew of the steamer. It appeared that the sailors whu worked the gear used on the occasion were, by contract between the Company and the Asaociation, while so engaged, under the orders of the foreman of the Stevedoring Association, which employed the plaintiff. It was contended by counsel for the defendant that the plaintiff and the persons whose negligence, it was alleged, had caused the accident, were in common employment. The Jury found that there had been negligence, and returned a verdict for J3IGOO toy the plaintiff, subject to questions of law.
