This Day. (Before E. R. Good and A. Todd, Esqs.) Fishing Without a License.— James j Kennedy, of Cust, was charged -with having fished without a license on Nov. 28. On the application of Mr Spackinan, counsel for the prosecution, the case was adjourned for a month. Mr Helmore appeared for defendant, against whom there are two other charges of a similar nature. Civil Cases.— H. J. Hopkins v. Mrs Radcliff, claim .£6 13a 4d. Mr Helmore for defendant. Defendant, a widow, had paid £.12, but disputed her liability to pay the balance, .£6 13s 4d, a debt contracted before her husband's death, which occurred on Oct. 24. Plaintiff stated that defendant borrowed money from him to pay her husband's life insurance premium, and said at the time that on account of plaintiff's kindness he should not lose a penny of the debt. When defendant paid the .£l2 she led him to understand that the balance would be forthcoming', but subsequently she wrote him a note saying that she could not pay her husband's debts. Defendant's evidence was to the effect that her husband left no .property to administer. When she paid the £12 she told plaintiff that it was her own account of £10 1-ta 4d, £1 borrowed for the life insurance premium, and the balance for interest and kindness. She told him two or three times over that she could notpay her husband's debts. Miss White corroborated the latter portion of defendant's evidence. The Bench had no alternative but to nonsuit plaintiff, with ] costs against him.
