RE CHARLES O'MALLEY.
A meeting of the creditors in this estate was held in the Official Assignee's office this morniner. Mr W. A. Thomas prosided, and Mr Bruges appeared for the debtor. Mr B.yrne appeared on behalf of the creditors. The bankrupt's statement was as follows :— -Stock at Glenmark, &i 6s ; Look debts. £161 15 a; total, £164 Is, a surplus of £39 8s ; and unsecured creditors to tbeamountof .£124138. Theunsecuredcreditors were : — J. Jackman, contractor, .£9 Is ; M. M'Namara,^ 183 ; E. Kmgan, £6 6s ; W. Gilcbrist, £11 10 a; Victor Harris, £20; Benn and Co. (Amberley) £20 ; W. Hoban, £X Is; Mason. Struthers and Co., £85 E. J. Hardie, £20 % "W. Eussoll, JE2 5s ; D. Stranaghan, 12g ; P. O'Malloy, wastes, £3. 10s; J. O'Malley, wages, .£ft 10a; Dr Ned will, .£ls. The debtor's statement was to the effect that he had been a contractor for sixteen years, and was now resident at Sumner, in a house rented from Mr Clark. The last contract he had was cleaning out a lagoon for Mr G. H. Moore, of Glenmark, at £450, which had to be 3niahed in six weeks; but owing to the number of extras it had taken ten weeks to complete, and he had only received £422 on account of it. He had sued Mr Moore
For J2IGO. He had filed in consequence of pressure by several creditors. He had two horses running at Gleninark. Being sworn, the debtor, in reply to Mr Byrne, said that the statement of payments made from the last contract, according to the list handed in, wan made by himself -and Mr Moore from oiders given. He was going to bub Pdr Moore for about .£195. Mr Joynfc hud recommended him to go on with the case. In March he owed .£272. He had gone to Mr Bruges with regard to the case, but had subsequently gone to Mr Joynt, as Mr Goodman wanted some inon*?y down to carry on the case. When he received a cheque for .£IOB--ho had paid the amonu tn wtvy to different: creditors. He had paid his brother Peter a lump sum of .€3O for wa!?<>B <;n March 14. Paid him also £b for rent of a horse. Did not know at tho time tint iie sworn in Court that the lurse belonged to Peter i that he was an uncertiflcaied bankrupt. He had charged the men who used ifc for tho horse feed that was supplied by Beau and Co. A somewhat animated di&cussion here ensued respecting the manner in which thedebtor had kept tiis book?. Subsequently, at Mr Thomas' suggestion, it was decided that Mr O'Mall«y should make up hisBtatemenfc of accounts and present them tothe Assignee. In reply to Mr. Bruges, thfr debtor paid his furniture wah ouly worth about .£lO. It ho had received the £160 to JBIOO duo on the contnv.-t by Mr Moore,, he should havo been ablo to tquaro all his creditors, and the contract would havepaid. H« had been advised by Mr Bruges that his claim was a one, but ho had gone to Mr Joynt because Mr Goodman had asked 303 for :* writ, and he had no money to pay it.
