This Day. (Before B. Beetham, Esq., 8.M.) Civil Cases. — The case of Beed v.Malcolm wsb adjourned to Dec. 3, and that of Blackburn v. -Poulson to Dec. 24.-— Williams v. Fleming, claim _B 9 lis Bd. Mr Stringer for defendant. This was an action to recover commission on the sale of a farm. Plaintiff's managing clerk, G. F. Wright, had introduced- a Mr Kinley to defendant as a possible purchaser, but no sale was effected at the time. Kinley some time afterwards saw the defendant by himaelf and concluded the purchase. There had been some previous negotiation on the matter j between Wright, Kinley, Fleming and Mr : Swarm, defendant's brother-in-law, but nothing definite bad been arranged. Wright swore that Fleming had agreed to pay bim commission. Fleming denied tbis, and tiie case was adjourned to Dec. 3- for the ; evidence of Kinley, who was not present. •
