NAPIER, Dec. 14. ; Fifteen Salvationists ffere summoned to- ! day for creating a nuisance in the streets :by their marchings with instruments. ' After a lengthy hearing, in which the facts I were not disputed by counsel, it/ was i argued that the by-law was ultra vires, 1 and an infringement of the liberty of the : subject. The B.M. reserved his decision until Saturday. The Supreme Court sittings were temporarily interrupted by the departure of , the Chief Justice for Gisborae, to hold a I sitting there. On his return the sitting here will be resumed. So far the civil business has not been of much interest. The greater part of the time was occupied 1 by the case of Paora Kaiwhata v. Russell. j Plaintiff claimed .£12,000, being the pur- ! chase money of Captain Russell's Tunanui property, with compound interest since 1870. The deeds are all in order, but plaintiff alleges that he never received the money from R. D. Money, to whom Captain Russell paid it. The case was heard by the Chief Justice without a jury, judgment being finally reserved. In the case of O'Brien v. South British Insurance Company, his Honor, after two days' consideration, gave judgment for the Company on all the issues, on the ground of misrepresentation as to the value and position of the haystacks which were burned. A special jury "heard all the evidence in the case Blackburn v. Carlile and M'Lean, a suit for alleged neglect of debts when acting as plaintiff's solicitor, but the Judge had then to leave, and it was finally decided by the parties that the jury should be discharged. The whole case is to be heard de noi-o at the next sitting of the Court.
