COSTS IN INSOLVENCY CASES. A DIVORCE SUIT. AUCKLAND, August 14. Mr F. D. Fenton was a passenger by the Rotomahana for Wellington, it is understood, in answer to communications from the new Ministry. Owing to some le^al informality in the ■ permission given to open the tramways here, tramcars cease running after to-day till the hitch is settled at Wellington. In dealing with some bankruptcy cases ■ in Chambers this morning, Judge Gillies j expressed the opinion that in an estate where the assets were trifling, debtor's solicitors should not be allowed full costs. The estate under his notice at the time could not pay a halfpenny in the pound. To grant debtor's solicitor full costs would be to sweep away more than one-third of the assets. Under the circumstances, he thought five guineas quite sufficient. Proceedings are being instituted under the Divorce aud Matrimonial Causes Act by Mrs Josephine Anne Gibbons, for the purpose of obtaining a judicial separation from her husband, Ebenezer Gibbons, timber merchant, Onehunga. The principal reason alleged for the action is the continued cruelty on the part of respondent, one other assigned cause of complaint on her i part being that her husband had installed a female servant in her pJace in the household. There is no issue of the marriage. Respondent denies all his wife's allegations, and opposes her suit. The racehorses Nelson and Wapiti were shipped by the Rotouiahaiia for Christchurch.
