This Day. (Before John Oliivier, E.M.) Civil Casb.—H. Hardeoke v. P. Gain, claim £l 4 7s 9d, for board and lodging, oash lent end refreshments. Mr Nolder for the plaintiff and Mr Joyoe for defendant. Mr Joyce raised an objection to certain items in the aocount aB not explioit enough, and pointed out that two items in the account — refroahments, £1 ids and £1 — were very large amounts to be expended in that manner. William Matheson, book-keeper for Hardecke, deposed that he entered up the amount of Cain's account from a elate, on whioh the amounts were recorded by plaintiff. Mr Joyce objeoted to the book as secondary evidenco. The Bench admitted the contents of the book as evidenoe. William Matheson gave eyidence tbat the amount!
wore for board and lodging, drink supplied, and oash lent. The cash was lent to pay some Court oosts. Witness bought the debt from Hardecke on July 3. Saw Hardeoke lend defendant several sums of money. The amounts were entered in the books. £7 or £8 wes lent Cain one day by Hardeoke to pay for some furniture bought at Willcox'-- ; othor amounts were advanced by Hardeoke on that day, but were not detailed on tbe books. The whole amount was lumped when entering the aooount. Mr Joyce objr otei to the book as evidenoe, as it was not a true copy of the slate from whioh the acoount was taken. The Benoh admitted the objeotion, and nonsuited the plaintiff, with costs £2. ' Cattle Tbespabs.— Higgs, for allowing I J-hree cows to trespass on Selwyn street (three pr* vious oonviotions having been entered again.^ him), was fined 20s and 9s oosts.
