This Day. (Before G. L. Mellish, Esq., R.M.) JTobgino and Uttbeino.— Daniel O'Brien alias John Foloy, on remand from Timaru, was charged with forging and uttering a ■cheque for £10 on the Union Bank of Australia, Temuka. ■ Austin Kirby, a detective stationed in Timaru, deposed that on Dec. 18 he arrested prisoner on a warrant, charging him under the name of John Foley with forgery. He replied that he had been at tho Ghristchurch races, and had lost £5 in bets ; that there were two frionds with him ; that he had told one of them that he had lost all his money, and that one of them lent him £2. A few daye afterwards a brother of the person who nad'lent him the money, told him if he did not repay it he would knock his head off. Ho was afraid of him, and went into one of the hotels iin ■Christchureh — he believed the White Hart. There he got a blank cheque, aid signed it'in his own name, Daniel O'Brien, and.endmrsed.it in the name of John Foley. He bad a friend at the Kakahu, and believed nis name was John Foloy, but had Bince ascertained 'that tho namo wos Andrew M'Oarthey. M'Carthey often told him if he he wanted money, to let him know, and some -would be sent. He also believed M'Carthey had ift banking account at Tomula, and did net- think he wus doing any harm in endorsing the cheque. _ To Inspector Hickson-.: Prisoner was cautioned before he made any •statement, that anything he said would be .given in evidence against him. Prisoner also jaid that he gave the cheque to Mr Barrett, •hotel'keeper, Ghristchurch ; who let him have .••ifewjpounds on it. Witness could say that i ithere was no branch at Temuka of the bank in question. (Prisoner, when arrested, gave •the- name of Daniel O'Brien. At this stage inspector Hickeon applied for a remand. Prisoner was -remanded until Tuesday, a witmeis having to be brought up from Timaru.
