DISTRICT COURT.
Monday, apeil 21. (Before His Honor Judge Ward). The District Court session was opened ab 11 o'clook this morning.
GBAY V. M'OtTIXOCH,
In this case, Albert Charles Gray, late of Ohristchurch, now of England, gentleman, sued Samuel F. M'Culloch for the sum of £120, interest on loan at 12 per cent per annum.
There waa no appearance on the part of tha defendant, and the case was undefended. On the application of Mr O'Reilly, tha case wa« held over until two o'clock, for tht production of evidence. At two o'clock, Mr O'Beilly stated that he had seen his client, who promised to be in attendance. His claim was for 12 months' interest on £1000, secured by mortgage. His Honor did not contemplate railing any objection, but he would point out that tha security by mortgage should hare been duly specified. Hii Hon «r presumed there waa potrer-of-attorney, which would bo produced. Witness was not prepared to do this at the present time. Payment* on the mortgage had been received. He produced the deed of mortgage. The case was further adjourned until next day for tho production of the power of attorney, with evidence as to handwriting. M'OLBLIiAND T, GILLINGHAM. In the case of J. Johnston M'Olelland t. Stephen Gillingham, in whioh plaintiff sought to recover amount awarded by an arbitration, with coats, amounting in all to £117 18s 4d, the matter was adjourned until the next day. Mr Izard wo* for plaintiff, and Mr Porcival for defendant. "WILLIAMSON V. BUXTOH. In the matter of Elkanah Williamson (builder) v. Joseph *. Buxton, a balutice of contract, £157 lfo 4d, was sued for, and the liability was in part disputed, as unauthorised extra charges. The case was adjourned by arrangement to May 20. AUISEBBOOK AKD M'DOTTGALL V, E. C MOtJLDEY. Plaintiffs in this case sought to recove..* balance of account for goods suppliod to j Thomas Poole, baker, by orJor of defendant, the defence being simply that there wa§ no indebtedness as alleged. Adjourned to May 20, by consent. The remaining cases on the list were called orer, and were disposed of as follows :— Thornton and Bull v. Mount Cook Road Board.— Adjourned to May 20, by consent.
