LYTTELTON.
(Before W. Donald, Esq., R.M., and Captain F. D. Gibson.) Assault. — The captain of the barque Thomas Daniels was summoned by the cook of that vessel for an assault. There was no evidence to prove it, and the chse was dismissed. Refusal of Dvty. — W. Pinkfleli?, seaman onboard the barque Union, was charged as above. Captain Roberts proved the offence, and the Bench gave the prisoner his choice, either to return to duty or to go to prison. He chose the latter, and was sentenced to 7 days' imprisonment, with hard labour. civil cases. Oliver's Fstate v. the Owners of the Barque Tell. —£2 7s 4d. Mr Nalder for plaintiffs. Judgment by default. The following cases were adjourned for a week: — Gritfifths v. Johnson, £5 19s 3d; and Cummins v. Johnson. Mr Nalder ap--1 peared for the plaintiff in both cases.
