Supreme Court

This Dat. (Before Mr Justice Gresson.) His Honor sat in the Court Chambers at 11 o'clock this morning. BE GEORGE STANDEN, DECEASED. Dr Foster applied for letter* of. administration, with the will annexed. The application way ordered to stand over until Friday next In Bankruptcy, re james fergoson douglas. This w»i an adjourned implication by Dr Foster on beha'.f of John Holme Twentyman (trustee) for an order of adjudication and meeting of creditor! in re Jameg Ferguson Douglas, a debtor. The application was made on a former Chamber day, and postponed, in order that Dr Foster might produce authorities which would warrant the Court in making the order as prayed, the petitioning creditor being trustee. Dr Foster stated that he had found several cases, and would be able to satisfy his Honor as to his power to make the order as prayed. ( The learned counsel cited a case in Chitty, and Hope t. Meek, in 10 Exc. pp. 841-2.) His Honor said he would look into the cases, and most probably make the order during the day. Dr Foster stated that he wished to address the Court as to the form of order which should be made. There was a distinction between orders on the petitions of debtors and those of creditors. The order on a debtor* petition was made absolute in the first instance, and when made on a creditor's petition it was conditional. He would therefore apply for a conditional order, allowing the debtor time to shew cause against the adjudication. His Honor granted the conditional order at a subsequent period of the day. BH HENRr DUNSFOKD. Mr Garrick, on behalf of the Bank of New Zealand, applied for an order ior leave to prove and to share rateably with the creditors who proved at the date of the final order, namely, the 12th March, 1868. His 1 lonor said it appeared that no dividend had been declared, and there would therefore be no difficulty in making the order. Order made accordingly, giving the Bank leave to prove their claim and share ratuably with the other creditors. RE SAMUEL PAULL ANDREWS. Mr Bamford applied for an order confirming the choice of trustee, and fixing a day for last examination and discharge. HW Honor confirmed Mr Graham's flppointment, and fixed the last examination for Thursday, the Bth October. Ik Banco, feauon and others v. Btmington anl> ANOTHER. This case was set down for argument, but was postponed until Friday next. Mr Harper is counsel for the plaintiffs, and Mr Wynn Williams for the defendants. RE JAMES WILI/WAT TREADWELI,. His Honor gave his decision in this matter to-dtiy, suspending the order of discharge for three months from date.
