Before commencing the business of the Court this morning, Mr Kenny said: A itreat deal of misapprehfnsion appears to exist regarding clause 36 of the new Mining Act Amendment . Act, 1896. That is a clause which provides for a reduction of t*>e rent from ten shitting! Eer acre to five shillings on lioensei oldinga or spcial claisi*. I am ol opinion that this section Jkas as) reti«> spective effect, and that it applies only to licensed holdings si. bed by me, as Warden, after the 17th October, 1806— the day on which the Act cane into opera ion, and to special claims siined by the Minister after the 17th October, 1896. I shall adhere to this ruling unlem the Supreme Court decides that it is incorrect. Any person wishing to test tho question can easily do so*
