The plaintiff proved the defendant's confessing the debt, and said ho owned horses and other property. Ordered to pay debt by June 16th, failing payment, to undergo one month's imprisonment at Mount Eden. EHBENFRIED BUOB. V. YOUNG. Claim, £14 Is 6d. John Young, the defendant, deposed, he had not paid the debt as he had net the means. Mr Ehrenfried offered to give! him the whole of the debt if ho wouldi clear out of his hoi el at Tairua. There is no turniture in the house. .'B. v. Greenwood deposed to > purchasing: the potatoes from Cato, Porter's agent; I He agreed to purchase a certain quality,! and the potatoes supplied to him were bad. He never told Cato he could not pay him because he had a bill to meet. Cato admitted the potatoes were bad. He! 1 tried to sell the potatoes, but they were: sent back as worthless. He sold the potatoes at 3j per cwt. for pig feed. The potatoes were of no use to anyone but for that. ° :
;. W\ P. Portor deposed that the potatoes were a good sample, and were bagged every evening. They did not lie in the sun.' The potatoes were sold; to Greenwood one week after they came out of the ground. The potatoes were not very ripe. William Oato deposed he had sold the potatoes ;to Greenwpod•; for £6 per ton. Greenwood saw the potatoes at the boat; : When they/were delivered he: saidithey would have been, better if: they had been riper. SHEPHEBD V. BEtTCK. Claim, £14, cash lent. Mr Dodd for plaintiff, and Mr Miller for defendant. Edward Shepherd, sworn, deposed—l was at Sydney, N.S.W., in February last; I saw Malcolm Bruce there, and paid: £io for his passage' over to Auckland! in the ''City of Sydney.' 1 T was' to Jpay his "ex periscs and they were'to' be refunded, jit said .he had lost, his passage by ' the Hero* and wanted.to go back. When in Auckland I gave him £4 to" pay a policy. ' Malcolm Bruce, defendant, sworn, deposed—While, ;in Sydney Shepherd paid my passage from Sydney to Auckland 1. He did this as fee wanted me,to wait in Sydney for him, and be was to pay my expenses and- passage, which he did. The £4 paid in Aucklaud was part payment of the £25 for the share,in the lead mine purchased from me by plaintiff; I hare received other sums on account of the share. , ' :'., '',.'' y Albert Bruce, sworni : .deposed —I recollect being, with, Air M. He gave me the promissory note produced for £12. It was presented and refused. The man owed me £12 for board at Tairua. I boarded two of, them. What defendant states is not true about the still. I knew defendant's mates were making whisky, but I didn't supply the still and sugar. , I ■By defendant—l knew nothing about the still. I did not supply it. Wiggins; one of the men, did not come to my place and put the still together. Defendant: You swear false. : J. W.
