THIS DAY.

(Before Colonel Fraser, E.M.) lABCENY.

William Jennings and George Powell Were charged with stealing two turkeys, the property of James Thompson. Mr Miller appeared for the defendants, who pleaded guilty. Mr Bullen stated that Thompson had missed his turkeys yesterday, and information was given to the police, who, on searching the nearest house, found a number of feathers and some grain in the defendants' shop. They proceeded to the residences of the defendants, and one of them, Powell, at first denied all knowledge of the larceny, but admitted to killing them and taking them when one was found in his house. The other turkey was found in Jennings' possession.

-Mr Miller stated defendants had been caused a deal of annoyance by the plaintiff's turkeys going about their workshop, and they had killed them more out of revenge than for the sake of the birds. Mr Bullen gave both the men good characters. He, had known one of them for nine years, and the other for fire years, and had? nerer heard of them commUting a dishonest action. His Worship said the case was simply .this :' Here were two very honest men guilty <tf stealing two turkeys, and he thottftH under the circumstances he wouflid/be justified in letting them off witfi seven days' imprisonment each.
