RESIDENT MAGISTRATE'S COURT

THIS DAY. (Before W. Fraser, Esq., K. M.) ASSAULT. Eanapia, a Maori, was charged with assaulting one Thos. W. Allen by kicking him on the shin, and attempting to bite his nose on the 11th inst. Defendant didn't know anything about it. Mr Bullen said the assault was alleged to have been committed on the 11th instant at Ohinemuri. There was a further charge again t the prisoner, which could have been dealt with by a Justice of the Peace. , ; T. W. Alien proved that the man came to his house and said he wanted sugar. Upon his being admitted' he said he did not want any sugar, and refused to go out. Upon plaintiff's openiag the door for defendant to go out, he (defendant) seized him and committed the assault complained of. ; ' ; Accused by Mr Wilkinson stated he had no questions to ask, as- he did not remember anything about it being very drunk. O. O. Grant-also deposed to seeing the ! native attempt to bite Allen in the face, I and kicked him. :

This was the first charge. Eanapia was also charged that he did unlawfully and maliciously break and burst open the door of a house the property of Thomas W. Allen, and known as the Eobin Hood Hotel, thereby causing damage, injury and spoil to the said Thos. W. Allen, to the value of 30s.

Accused pleaded guilty to this charge. Constable Stanger was put into the box and deposed that a number of natives were drunk on that; day at Paeroa, of whom the accused was one of the principal, and he struck at the constable when warning him before. In the first case as the costs were very heavy His "Worship said he would inflict a smaller fine than he otherwise should should have done, viz., 40s and costs or one month's imprinonment. In the second case a fine of 20s and costs and 30s id Allen,- and payment in a month's time to undergo another month's imprisonment with hard labor. \ ; His Worship expressed Ms regret that the offence was not dealt withatOhinemuri, and requested Mr Bullen to inform the officer in charge of the constabulary at Ohinemuri what were his on the subject, as the offence -anight have been dealt with there, and much expense saved.
