Samuel Thornally was charged with cruelly illtreating a horse under his charge on September the Bth, by beating it with • hammer in Pollen street. _ Mr Brassey was retained tor the defence.

For the prosecution there were examined Mr W. Robinson, of the Advertiser, who prevented Thornally from further illtreating the poor animal by taking the hammer from him, Mr It. Itennan and Mr Benney, and from their evidence it appeared that on the day in Question Thornally was engaged in carting quartz to the Queen of Beauty battery, and for this purpose the horse was in his charge. Being enraged he commenced a savage assault on the poor animal with a hammer similar to those used in breaking up pieces of quartz the weight of which was sworn to as being about olbs. With this formidable instrument he cruelly beat the wretched horse, striking it under the shafts on the region of the belly severely until he was stopped by Mr W. Robinson in the manner described, he seized Mr Robinson by the throat and endeavoured to retake the hammer but to no purpose. The other two witnesses were strongly eorrobative of these statements. Mr Brassey called Messrs McCarthy, Darrah, 'and Thdrburn,whoendeavoured, though in vain, to disprove these facts. ; ' The Bench fined the defendant 40s arid costs, and' in passing sentence took the opportunity to testify; their appreciation of the part Mr Robinson, had taken in preventing further suffering being inflicted on the horse.
