MAEBH Y. THACKERAY. A claim of £3 2s 6d for supplying 5 tons of firewood. This case was adjourned from yesterday for the production: of a witness as to the price which Marsh had agreed to supply the wood, at, there being a dispute of 6d per ton between them. James Harden deposed — That he was -a miner. Bcmembered a conversation between the parties regarding firewood, lhackeray gave Marsh an order for 5 tons of fire-j wood at 12s Td. The price of firewood 1 at the time was 13*. I am sure the agree- '' ment was,l2s 6d per "ton.- Had h&d.no!
communication with plaintiff since yesterday. His Worship gave judgment for plaintiff for amount claimed and 6o~sts 36195. Defendant submitted to the Court some bills to show that plaintiff .had sold wood at 11s per ton, but that was in 1873. 2 Hii? Worship told defendant that'no documents he could bring of that nature would affect the judgment afterthe evidence given by Harden. The Court adjourned.
