This was a claim of £2 16s, money lent. A set off was filed, and 16s 6d paid into Court.

Mr Macdonald for plaintiff said the money paid into Court had been accepted in satisfaction.

3. BODDEB V V. B. PACKHABD.

A claim of £9 for money lent, &c. Mr Macdonald for plaintiff. Defendant disputed the 60 per cent interest.

It appeared tiat the defendant had induced plaintiff to borrow £10 for him from a third party, that defendant had gone to Queensland, and that the interest on the money had accumulated, the plaintiff paying some of the interest out of money which he collected for defendant, and the rest out of his own pocket. Plaintiff now sued for the debt, defendant haying declined to settle. J. Nodder deposed—That Mr. Packhard asked him to lend him £'5, and offered as security rent due from a tenant —Mr. Turner. Witness borrowed the money for witness, the rate of interest agreed upon being 10s per month. The bill produced was signed by defendant. Defendant went away then. Witness paid some of the interest out of money collected by him for defendant. Defendant subsequently refused to pay, and witness had to renew tbe bill each succeeding month. Witness had made himself responsible for the money. Asked defendant to get £5, and he would endeavor to do the same, so that they might clear off the debt. Defendant refused to do this.

Defendant cross-examined the witness

P. R. Packhard wasexamiued. He acknowledged having borrowed the £10, but had only agreed to pay the 10s interest for one month. At the end of the month plaintiff had agreed to take up the bill. Judgment for. plaintiff with £2 4» costs.

ADJOUBNED CASES

J Wilkes v. C. F. Mitchell—a claim of £9 os 6d for goods ; Owen Griffiths v. J. C. Akers—a claim of £10 7s 9d for cartage. The Court then adjourned.
