Plaintiff now sued for the debt, defendant haying declined to settle. J. Nodder deposed—That Mr. Packhard asked him to lend him £'5, and offered as security rent due from a tenant —Mr. Turner. Witness borrowed the money for witness, the rate of interest agreed upon being 10s per month. The bill produced was signed by defendant. Defendant went away then. Witness paid some of the interest out of money collected by him for defendant. Defendant subsequently refused to pay, and witness had to renew tbe bill each succeeding month. Witness had made himself responsible for the money. Asked defendant to get £5, and he would endeavor to do the same, so that they might clear off the debt. Defendant refused to do this.
