Defended Cases. Charles Judd v. Old Whau G.M.Co.— Claim for services and goods £38 10s 6d. Mr. Tyler for the defendant; Mr Macdonald for the plaintiff. : Mr. Tyler applied for an adjournment on the ground of a material witness being absent in Auckland.

Mr ,_Macdonald objected on the grounds that his witnesses were here, and he was wady-togo on. £18 had been paid into Court.

Adjourned to the 7ta August, plaintiff to pay the costs of the day—£3 Is.

™Mjf B™S9e J fop the defendant; Mr. Macdonald for the plaintiff. Mr; Macdonald said the action arose out ot the _sale of some property belonging to the plaintiff by the defendant. Mr. Brassey said that he understood by telegram to withdraw the. case. The defendant had no notice of it. He, Mr. Brassey, was of opinion that the case was being proceeded with in order to secure costs.

Mr. Macdonald admitted that the debt had been paid by cheque, but after the action had been commenced. Mr. Brassey said the cheque was qphed before the summons had been served. Mr. Brassey applied for costs. His Worship declined to give costs in either side, he would call it settled out of Court.

Court adjourned.
