Mr. Tyler for plaintiff; Mr. Macdonald for defendant. Mr. Tyler stated that he > had at a previous hearing of the case applied for an adjournment, to be enabled to amend preliminary proceedings that had been taken in the action. ■, Mr. Macdooald said 15s had been paid into Court, which was all he could confesi to having owed. A discussion ensued, during which it appeared that the paddock the horse had been grazing in was a partnership affair. His Worship directed a nonsuit to b* entered. PATTISOIT V*. FOtraHKT. A claim for wages, £8 2s, for. working a half-share in the Shotover tribute. Mr. Tyler for. the plaintiff; Mr. Macdonald. for defendant. The defendant William Forighey said that he was an agent in Grahamstown— had some time since sold a half-share in the Shotover tribute to Styles, who was at that time a workman, he thought Styles had left the province ; it was not he who owed the money to plaintiff, but Styles. He had 30s of Styles' money which he would give to plaintiff, also the half-share in the tribute. ,' •"., ' Nonsuited, with costs £1. Court adjourned. ' .
