Mr. Tyler stated that he > had at a previous hearing of the case applied for an adjournment, to be enabled to amend preliminary proceedings that had been taken in the action. ■, Mr. Macdooald said 15s had been paid into Court, which was all he could confesi to having owed. The defendant William Forighey said that he was an agent in Grahamstown— had some time since sold a half-share in the Shotover tribute to Styles, who was at that time a workman, he thought Styles had left the province ; it was not he who owed the money to plaintiff, but Styles. He had 30s of Styles' money which he would give to plaintiff, also the half-share in the tribute. ,' •"., ' Nonsuited, with costs £1. Court adjourned. ' .
