Liability For Accidents
(N.Z.P.A.) WELLINGTON, Aug. 17. The liability of the Crown for damage which may be caused by Service aircraft is subject to the Crown Suits (Service Aircraft) Emergency Regulations, 1945, which were gazetted to-night. By virtue of the Crown Suits Amending Act, 1910, members of the Defence Forces are not deemed to be servants of the Crown. Consequently, damage or injury caused through the use of a service vehicle by a serviceman was actionable only as against the serviceman personally. The Crown Suits (Service Motor Vehicles) Emergency Regulations, 1942, remedied this situation insofar as the use by a serviceman of a Service motor vehicle was concerned, by providing that any serviceman in charge of a Service motor vehicle should be deemed to be a servant of the Crown. The purpose of the regulations now gazetted is to effect a similar provision in the case of a serviceman in charge of a Service aircraft in order to permit an action to be taken against the Crown in respect to damage or loss caused through the use of such aircraft while in the charge of a serviceman.
