MAGISTRATE’S COURT

BY-LAW CASES DEALT WITH Several minor cases were dealt with at a meeting of the Timaru Magistrate’s Court yesterday. Mr H. Morgan was on the Bench. A plea of guilty was entered by Nelson McVey to charges of driving a motor car on the Timaru-Pleasant Point highway on November 24 without being in possession of a driver's licence and with driving in a negligent manner. Senior-Sergeant D. J. Hewitt said that defendant was driving towards Pleasant Point and another motorist was coming towards Timaru. When near the Levels, the other motorist saw defendant approaching on his wrong side, so he pulled up. Defendant continued on his wrong side, but when near the other car he swerved out. He did not turn soon enough, however and struck the other car. The question of speed was not involved Mr R. Stout said that the defendant had inherited the car from a deceased brother. It was not now possible to procure a licence at Albury and defendant was waiting to procure one in Timaru, but at the time of the accident he did not possess one The Magistrate said that the road was a wide one, and he wondered what defendant was doing when he saw the other car. On the charge of having no licence he would be fined £1 and 12/- costs and on the charge of negligent driving he would be fined £4 and casts £l/8/2. James Morton pleaded guilty to a charge of turning his car in Stafford Street at a point other than an intersection. Senior-Sergeant Hewitt said that defendant had been turning his car when Constable Gregory, who was riding his bicycle, collided with the car, no warning having been given bv the driver. J A fine of £1 and costs 11/ was imposed. For failing to give the right-of-way to a pedestrian on a pedestrian crossing, John J. Breen, of Invercargill was fined £1 and 16/- costs. John Charles Pankhurst. did not appear to answer a charge of displaying a wrong classification disc on his heavy motor vehicle, and was fined £1 and 10/- costs.
