FAIRLIE FARMER FINED FOR CRUELTY

Case In Magistrate’s Court Horses Left Tied With Short Chain Charged with cruelly treating two horses by tying them together and turning them out in that condition for several days, George Henry Patton, a farmer, of Allandale, was convicted and fined £2/-/- when he appeared before Mr H. Morgan. S.M.. in the Magistrate's Court at Fairlie yesterday. The case against Patton was conducted by Constable A. Mackintosh. Patton pleaded not guilty and elected to be tried summarily. Constable Mackintosh said the defendant turned two horses out tied together with a short length of chain. They had bridles on and bits in their mouths. When he saw the horses they were in poor condition and there was little feed in the paddock. One of the animals had a sore behind its ear where the bridle had rubbed. George Gliddon. an inspector for the South Canterbury Society for the Prevention of Cruelty to Animals said he had visited defendant's farm on May 1. He found the two- horses in a paddock on the Cattle Valley) road. They had winkers on and were tied together with a short piece of plough chain measuring 17 inches. He removed the winkers and on one horse found a large raw fleshy wound behind the ear. This, witness said, was caused by the irritation of the bridle when the chain was pulled in the movement of feeding with the other horse. The horses were in very poor condition and when the bridles were removed they immediately went to feed at the long dry grass near the gorse hedge.

Defendant in his statement said the horses had been busy harrowing. | One was a bad jumper. The chain had I been on for only a short time. Hel came home one night and _ound them I at an oat stack with the coupling i chain broken. He caught them and coupled them with the short chain,| intending to make repairs next morn- | ing. He had had to do repairs to a | drill and the job had been left till later in the morning, and in the meantime the constable and the inspector appeared. Defendant denied that the horses had been tied for any length of time and maintained that the bits were in their mouths only from one night until the next morning. One horse was fairly old and this accounted for its conidtion. The fine mentioned above was imposed. Other Cases Francis Edward Esquilant, of Dunedin, was fined £3 and ordered to pay I costs for failing to gi-.e way to traffic on the right. Tire case was a sequel I to a collision on the Albury bridges when defendant struck a truck driven by Mr J. H. Smiilie. Judgment for the plaintiff by default was given in the following civil cases:—J. j. Sullivan v. W. Downes £2/11/- and costs; C. F. Bryant v. C. J. Arnold £4/15/- and costs; S. D. Candy v. R.
