In an effort to avert a party split, a group of Democrats have proposed to President Roosevelt a substitute plan for the Court reorganisation, where the retirement of Justices owing to age and also the increase in the Supreme Court membership will be eliminated. The proposals provide for legislation requiring a two-thirds majority in the Court in order to declare an Act of Congress unconstitutional. The sponsors believe that the majority of Democrats will support the substitute.
