Unusual features were associated with a case heard in the Magistrate’s Court, when Simon Edilson, orchardist, of Twyford, Hawke’s Bay, was charged with working at his trade in a public place on a Sunday by driving a truck carrying pumpkins. It was stated .that the defendant transported his pumpkins, which he claimed were perishable goods, to Wellington, leaving part of the load at Palmerston North. The police contended that pumpkins were not perishable goods. Counsel for the defendant said the latter lost more than a thousand sacks of pumpkins last year through not getting them to the market in time. He contended that cartage on Sunday was a necessity. The defendant therefore was exempted under the Act. The Magistrate held that the fact that a special train was provided at Hastings on Sundays for the carriage of produce made it unnecessary to take it by road. The defendant was fined £2.
