WIDOW SUCCEEDS By Teleeraob— Pfpb Association WELLINGTON, March 4 In the Supreme Court Eliza Smart, widow, and executrix of Edward James Smart, of Petone, claimed £297/14/3 special and £l7OO general damages against Leslie Charles Morrison, taxi-proprietor, and James Miller Pointon, a taxi-driver, on the ground of her husband’s death being due to Pointon’s negligence in failing to avoid him. The defence denied that death was due to the accident and also questioned items in the claim for particular damages. The jury awarded £270/10/- special damages and £637 general damages. The foreman explained that the amount of general damages was that which the jury estimated was necessary to pay plaintiff £3 a week for seven years, interest being allowed for at 3J per cent.
