United Press Association—By Electric Telegraph—Copyright LONDON, December 18. “I cannot believe that the law regarding a man’s wife is the same as respecting a man’s dog or a noisy machine.” declared Mr Justice Bennett, in the Chancery Division, reserving his decision when the neighbours of Edward Stutely, residing in a London suburb, desired to commit hiri to prison on the ground that his wife in his absence persistently cried, whined and moaned.

Mr G. T. Johnson, for the neighbours, said the nuisance was intolerable, and ought to be stopped. Stutely could either provide his wife with a companion, or remove her. Mr Justice Bennett said a man cannot muzzle his wife, or take her to an Institution if she does not want to go. Stutely attempted to provide his wife with a companion: one died, and the other left. His imprisonment would only increase the nuisance. Mr Johnson replied that the imprisonment of Stutely was the only remedy, owing to the unfortunate state of the law.
