NEW TRIAL ORDERED
AN AUCKLAND CASE By Telegraph—Press Association WELLINGTON, December 4. On November 1, Reginald Merton Semb, was found guilty by a jury at Auckland on a charge of conspiracy. This morning an application, brought by him for a new trial on the ground that his conviction was against the weight of evidence, came before the Court of Appeal. The Solicitor-General, appearing for the Crown, said, he also was of the opinion that the evidence was insufficient, and agreed to a new trial being ordered. He also said the Crown would not proceed with a new trial. The Court made an order by consent.
