John George Rutherford, a traveller, who was found guilty of the theft of liquor, the property of Hughes and Casson, of Auckland, by whom he was employed as a salesman on commission, was sentenced to two months’ hard labour notwithstanding his counsel’s plea for probation with a promise that restitution would be made from money to be made available for the accused, practically as a gift, by a friend. His Honour stated that it was not sufficient that the money should be paid back by another.
