The hearing has been set for Friday afternoon, on the defence motion to dismiss the indictment against Fortescue and the other defendants. Pearl Harbour is under a naval guard. The defence would not ask for bail because of the “tense situation,” but asked for freedom within the navy yard without bond, which the prosecution opposed. It is understood that the Governor, the prosecutor, and the navy conferred on jurisdiction, but would not divulge the result, saying the conference had not been completed. It is .likely that they are awaiting possible action by Washington.
