TIMARU—JULY 11, 1928. (Before Mr C. R. Orr-Wallcer, S.M.) Campbell, who appeared for the defendant, entered a plea of guilty. Senior-Sergeant Gibson said that the defendant had been seen endeavouring to start his car near Ballantyne and Co.’s premises in Stafford Street, and he was then under the influence of ’iquor. Defenda*“ who was a r _, l .man at jo. .1, had never been in trouble before, and bore a very good character. Mr Campbell said that on the day of the offence the defendant was unwell. He had commenced his work at 3 o’clock in the morning, and had had nothing to eat all day. He had had a nip or two of brandy, and that had been the cause of the trouble. In view of defendant’s good character, he would ask the Court not to take away defendant’s license, but to impose some other form of punishment. The Magistrate said that the offence was a serious one, but under: the circumstances he would not take defendant’s license away from him. A fine of £2O and costs 15/- was imposed.
BY-LAW CASES. William Lewis, for riding a bicycle on a footpath in Wai-iti Road, was convicted and fined 10/- and costs 10/-. , Cliff Shortus, Sarah Lewis and Charles W. Smith, similarly charged, were also fined 10/- and costs 10/-. Frank Hood, Robert Wilson, Charles Fraser, Evelyn Brassell, Ernest Nye, Ernest W. Spivey, Wallace Finlay, Syver Hanson, M. daft, John Stark, Cliff Shortus and Harold R. Preston, for cycling at night without lights, were each convicted and fined 10/- and 10/- costs. Albert Price, for riding a bicycle at night without a rear reflector, was ordered to pay 10/- costs. Henry Quinn was fined 10/- and costs 10/- for riding a bicycle at night without a light, and was ordered to pay 10/- costs for riding without a reflector. William Spence, John 0 Brien and J. R. Philps, similarly charged, were fined 10/- and costs 10/- on the one charge, and were ordered to pay costs on the other. . . , , Clarence Jackson, Leslie Richards, James W. Langrell and Ronald P. Breeze were charged with riding motor cycles •- at night without . tail lights. They were each convicted and fined 10/- and 12/- costs. Arthur S. Reynish, similarly charged, explained that the bulb of his tail'light had blown,, and he was ordered to .pay costs 12/- only. ■ Robin Hood was charged with riding a bicycle on .an. public footpath) With riding without- a light; and also With riding at night without a rear reflector. On the first charge defendant was fined 10/- and costs 12/-, on the' second he was fined 10/- and costs 10/-, and on the third was ordered to pay costs 10/-. Arthur Edward Hall was charged with failing to maintain his position to the left of the centre line of the road when turning from Stafford Street into Cliff'Street. He was further charged with riding a motorcycle without being in possession of a driver’s license. On the first charge defendant was fined £l/10/- and costs 10/-, and on the second charge was fined £1 and costs 10/-. Henry Gordon Shaw, for riding a motor-cycle without being in possession of a driver’s license, was . convicted and fined 10/- and costs 10/Arthur Gordon Knowles was fined 10/- and Costs 10/- for driving a motor-car without being in possession of a license. . Leslie Raymond West was charged with driving a motor-cycle and sidecar along Stafford Street in a manner which, having regard to the circumstances, might have been dangerous to the public. A fine of .£3 and costs 10/- was imposed.
* OVER-WEIGHT LOAD. Arnold Cross pleaded not guilty to a charge of operating a motor-lorry for the carriage of goods, such lorry not having been licensed in accordance with the Regulations. Inspector Newcome said that the defendant was driving his lorry with a load of coal on. He had a passenger beside him, and when the outfit was put over the weigh-bridge, the weight was 2 tons 2 cwt 1 quarter. Defendant did not possess a heavy traffic license. Defendant explained that the offence occurred during the wet season, and both the coal and the sacks were wet. A fine of 10/- and costs 10/- was imposed. A WARNING CASE. Frederick M. Ward, for parking his car on the wrong side of the road, was ordered to pay 10/- costs. The Magistrate remarked that as the case was the first of its kind in Timaru under the new regulations, it would act as a warning to motorists that they are not allowed to park their cars on the wrong side of the road. • CIVIL CASES. Judgment for plaintiff, by default, was entered in the following undefended civil cases: G. Gray (Mr L. J. O’Connell) v. W. Henderson, claim £4 18s 9d, costs £1 3s 6d; A. S. man and J. Crowe (Mr O’Connell) v. F. J. King, claim £2 2s 7d, costs £1 3s 6d; C.F.C.A. v. K. Johnston, claim £1 5s 6d, costs 9/-.
