MAGISTRATE’S COURT.

TIMARU, MAY 6th

(Before Mr E. D. Mosley, S.M.). THEFT. John Caulfield was charged with having stolen from Annie Elizabeth Gibson, at Pareora, the-sum of £ll, and a silver pencil valued at 5/-. Senior Sergeant Fahey stated that accused had been boarding with Mrs Gibson for about two months. He was under the influence of liquor, and he went into a room and took the contents of her purse,. amounting to £ll 18s. He then left the house. Mrs Gibson discovered her loss and managed to get £6 10/from the accused, who stated that it was all he had. She communicated with the police, and accused was arrested in Timaru with £3/8/9 in his possession. He was very drunk when arrested, and made no statement. Accused pleaded guilty. Senior Sergeant Fahey stated that the accused was a new arrival, and the only previous conviction known was for drunkenness. Mr J. Emslie, who appeared for accused, stated that his firm had sent him £5 wages. He was employed at Pareora, and had been sent over by a Melbourne firm. He had intended to ask for probation, but as the accused had a position to go to in Melbourne this would entail him being idle for some time. He asked that a small penalty be inflicted, and restitution of the money would be made. His Worship stated that he did not want to deprive the man of liis work. Pie warned accused not to come before him again or lie would have to be imprisoned. Accused was fined 20/-, with £l/8/- costs; and a prohibition order was ordered to be taken out against him. An order was also made for restitution of 30/-, in default 14 days’ imprisonment. REMAND GRANTED. John Charles Winter was charged that, on or about the 7th day of July, 1920, in New South Wales, he did steal the sum of £205, the property of Herbert Alexander Goodwin Robinson. The accused had been arrested on a provisional warrant. Senior Sergeant Fahey asked that he be remanded to Wellington on the 9th inst. Accused stated that he could go back to Australia, and put quite a different complexion on the matter. He was representing a firm with headquarters in Wellington. His Worship remanded accused to appear at Wellington on May 9.
