BOROUGH RATE.
DEMANDED TOO SOON. A few weeks ago the Toimika Hr.rough Council brought an action against. Is. Martin for the recovery ot water rates. Mr [C:nnerney. \vh;j appeared lor the defence, raised jioint that the demand for» the rates had been served upon Mr Martin before the rates were due, and therelure a proper demand had not been made, and consequently tile plaintiffs were not entitled to succeed. The Mown Clerk explained that the demand had been madti a fortnight before the rate,became due. :.' The Mag'strate in giving judgment for plaiiu:tls sad he recognised that a po.nt of some importance had been raised by counsel tor the defence, and •would grant leave to appeal. The appeal was to have been heard at the last sittings of the Supreme Court :>t Tiniaru. but failed to reach so far.
