DEFENDANT FINED. MAGISTR ATE'S IIE.MARKS. The auction case, inspector of Awards (Mr Lightfoot) v. Messrs .Samson and Co., of Duiiediii (Mr EmslieL an information laid under the "Shops and Offices Act,' - for a breach of the aiyard in exposing goods for sale on the statutory half-holiday, was continued at the Courthouse before Mr V. G. Day, S.M.. yesterday. His Worship held that if Jin auctioneer conducted a sale at another man's residence, and sold goods on the ball-holiday, the premises were not being converted into a shop in contravention of the Act. Holding a sale once did not make ihe place a. shop. A promises or building wherein an incidental sale took place was not a shop within the meaning of the Act. except when the sale continued for some days. In this instance Ihe defendant di«l conduct a sale which extended over several days. He had exposed goods for sale on the half-holiday, and that- was an offence even though thev wore not sold till the Saturday. The defendant was exposing his own goods for sale on tiromises occupied bv him. and was therefore committing a breach of the law. He would he fined £l. The case is the first local prosecution of its kind.
