The High Court, by a majority, Justices Isaai'6 and Higgins dissenting, declared that, clause 7 of the Commonwealth Trades Mark Act, whiting to workers' trades marks, or wh.it is known as tho Unionist label, Ls invalid, and that the Union label is riot a trade mark within the meaning of the law. The Chief Justice in delivering judgment declared that the clause va6 tin attempt to regulate th© internal trade of the States. It did not fall within, and was not incidental to any express powers conferred on the Federal Parliament, to I regulate that tiade, and except so far as these powers extended, the power of the State was exclusive. The Court made on order restraining the registrar from continuing to keep a register of workers' trade lrtarks.
