WELLINGTON, May 28. -: The Arbitration Court to-day resumed the hearing of the case in which E. R. Hodgkinsoh claimed £3OO compensation from J. J- KV Powell oh N account of the ko3 of, his left kg which Nvs*-amputated as the claimant alleged as the result, of an injurv received in respondent's quarry at- Pencarrow. Mr O'Regan appeared for the claimant, and Mr - Treadwell for , respondent. The leg was amputated at 'West-port, a year or so after the accidenthappened, and it -was--alleged'by'the respondent- in defence- that compensation .was paid to Hodgkinson at the time of the accident, and that, the amputation was rendered necessary on account of claimant's habits and through his own negligence. It was also alleged that claimant had given a receipt for £3 10s in = full satisfaction of his claims. In the. course of his evidence claimant denied the suggestion "that while the original injury to his leg was-being treated by Dr Mackin and subsequently., he was of intemperate habits. In opening the case' for the defence Mr Treadwell urged that there could be. no connection shown between the original slight, injury' and the amputation ; that the claimant had not taken reasonable means for minimising the risk of further injury, and that the claimant had given and knew what lie wn> doing when he gave a receipt in full for the .compensation received in respect of the original injury. The Court reserved its decision. ' ; The Arbitration Court delivered .its award- to-day in the bakers' dispute, Wellington industrial district. Special provisions are contained in the award with regard to the Hawkes Bay provincial district which were agreed on between the Union and the representatives <of the Napier and Hastings employers?.
