In this cto* the defendant was fcrnr.rly a lessee. of a ris;rve from th-3 Board a-j Waihaorunga. - The lease was for 14 years, and during the defendant s tenacy 'th- r*nt hud been reduced -by the Board out of sympathy for defendants struggled with adverse conditions to £62 16s 4cl per aimum, payable half-yearly. When the lease was -expiring defendant applied for some further consideration- on account of improvements effected on the- property, and the Board agreed to remit the halfyear's rent due on condition that nothing was inU-rf.-rc-l with on the. farm. Subsequently defendant- pulled up and io.mowd certain dividing fences, and the Board therefore rescinded its resolution granting th-:- nbate and decided to compel payment of the rent. Tli* evidence of R. Armstrong, the ingoing lefis.ee, G. H. Graham, clerk to the High School Board, and J. C. Hurst, a, farmer in tlr- neighbourhood, was taken for the. plaintiffs. After hearing counsel's argument, his Worship gave judgment for the amount claimed. £3l 6s Bd, witnesses expenses £2 16s. solicitors fees £2 12s and costs of Court £1 14s.
