An important point was raised,,.during Ihe preliminary hearing of the libel action by Florence Isabella Hall, of Masterton, against the " New Zealand Times," claiming £2OO damages. One of the interrogatories demanded the name of the papsr's informant. "Mr' Justice Cooper said that as the pap ir was prepared to take.- the responsibility, he must hesitata to order it to disclose its authority. Counsel submitted' that the sola question was whether "malice was in the issue. Defendant denied malice, and plaintiff was entitled to know the source of information in order to prove malice. His Honour said'that malics was in the issue in every libel, and the jury should be told to'infer it. It was a most important matter, from the point of view'of the press generally, as" well as from tha. of the particular'parties concerned, and lie would- tafca' time to consider.
