Mr Raymond stated that the creditors at their lirst meeting expressed informally a desire that the bankrupt should be examined, and the assignee, following that advice, filed, the necessary certificate. Since then the creditors had passed a resolution rescinding thei former one. The Deputy A4signee did not think the public interests would sufSLr by, withdrawal, therefore, with the sanction of his learned friend he asked leave to withdraw the application. His Honour therefore struck out the application. , " Rs Oliver Alsop, butcher, Cave.. Mr Rolleston applied for an order of discharge, v , In reply to His Honour, Mr. Rolleston said thtre had ,bepn no dividend paid yot, but one was about ;tq be declared. -. Mr 'Montgomery, Assignee, said that wan so, and the dividend.-would ba a substantial one, 13s 6d probably. The discharge was granted. .HOUR OF SITTING. Mr Rolleston . had stated that he had, as requested by His Honour made inquiry into the question of hour cf sitting. !lihe t members of the Bar hau no objection to the Court sitting at 10 a.m. A difficulty- would arise, however, ■with-parlies and witnerpes who had to come from the country by train.
